1. Service Provider

These Terms and Conditions govern your relationship with Future Developer Skills Academy LLC ("the Academy," "we," "us," or "our"), a technical education provider registered in the State of Texas (Registration Number: 804123987). By enrolling in our programs or using our website, you agree to be bound by these terms. If you disagree with any part of these terms, you may not access our services.

2. Description of Services

The Academy provides intensive technical training programs, including but not limited to Fullstack Software Engineering, DevOps & Cloud Systems, Data Science & AI, and Cybersecurity tracks. Services include instructor-led sessions, access to proprietary curriculum materials, code reviews, and career coaching services. We reserve the right to modify, update, or discontinue any part of the curriculum to maintain industry relevance without prior notice.

3. User Obligations & Conduct

As a student of the Academy, you agree to adhere to our Professional Code of Conduct. This includes:

• Academic Integrity: All code submitted for assessment must be your own work. Collaboration is encouraged during specific modules, but plagiarism of software architecture or logic is grounds for immediate dismissal.
• Professionalism: You must maintain a professional and respectful demeanor during all interactions with instructors, mentors, and fellow students.
• Participation: Immersive programs require a minimum of 90% attendance to qualify for certification and career services.
• Hardware/Software: You are responsible for maintaining the hardware and software environments required for your specific track as outlined in the course prerequisites.

4. Payment Terms & Refunds

Tuition fees are clearly outlined on our Pricing page and in your individual enrollment agreement. Payment schedules must be strictly followed to maintain access to Academy resources.

• Refund Policy: Students may withdraw and receive a full refund (minus a $250 administrative fee) up to 7 days before the cohort start date.
• Pro-rata Refunds: If a student withdraws within the first two weeks of a program, a pro-rata refund may be available. No refunds are provided after the completion of the third week of instruction.
• ISA Agreements: If you are enrolled via an Income Share Agreement, you are bound by the specific terms of the ISA contract regarding salary thresholds and repayment periods.

5. Intellectual Property

All educational materials provided by the Academy, including lesson plans, code snippets, instructional videos, and project briefs, are the intellectual property of Future Developer Skills Academy LLC.

• License to Use: We grant you a limited, non-transferable license to use these materials for your personal educational purposes. You may not distribute, sell, or publicly share our proprietary curriculum.
• Student Code: You retain ownership of the original code you write during the program. However, by participating in the program, you grant us a non-exclusive license to use your project work for promotional and instructional purposes.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Future Developer Skills Academy LLC be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, our services. Our total liability shall not exceed the amount of tuition paid by the student for the program in question.

7. Dispute Resolution & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Travis County, Texas, for the resolution of any disputes arising from these terms or your use of our services.

9. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
